Under the Interim Measures, employers lawfully hiring foreign nationals in China must enrol them in the five statutory social insurance types alongside Chinese employees. The coverage is mandatory and the employer bears the obligation to complete registration within the statutory timeframe.
Who Must Participate
- Definition of "foreign national working in China": A non-Chinese national who has lawfully obtained an employment permit such as the Foreigner's Work Permit of the People's Republic of China or the Foreign Correspondent's Permit, together with a foreigner's residence permit, or who holds a Foreigner's Permanent Residence Permit, and who is lawfully employed in China.
- Employer categories: Enterprises, public institutions, social organisations, private non-enterprise units, foundations, law firms, accounting firms, and other organisations lawfully registered or established in China that lawfully hire foreign nationals.
- Dispatch scenario: Foreign nationals who have concluded an employment contract with an overseas employer and are dispatched to work at a branch or representative office registered or established in China (the "domestic work unit") must also participate in social insurance. The domestic work unit and the foreign employee shall pay contributions in accordance with the regulations.
Five Statutory Insurance Types
- Basic Endowment Insurance (养老保险): Provides pension benefits upon reaching the statutory retirement age.
- Employee Basic Medical Insurance (职工基本医疗保险): Covers medical expenses for illness and injury. Maternity insurance has been merged into employee basic medical insurance.
- Work-Related Injury Insurance (工伤保险): Covers work-related injuries and occupational diseases.
- Unemployment Insurance (失业保险): Provides benefits upon unemployment.
- Maternity Insurance (生育保险): Covers maternity-related medical expenses and maternity leave benefits. In Foshan, maternity insurance is administered as part of employee basic medical insurance.
Registration deadline: The employer must complete social insurance registration for the foreign employee within 30 days from the date the employment permit is issued. For foreign nationals dispatched by an overseas employer, the domestic work unit must complete registration within the same timeframe.
Contribution Standards & Calculation

Foreign nationals participate in social insurance on the same contribution basis and at the same contribution rates as Chinese employees. The contribution base is normally capped at 300% of the Foshan average salary of the preceding year and adjusted annually or on an as-needed basis.
Foshan 2026 Contribution Rates
- Basic Endowment Insurance: Employer 16%, Employee 8%. Contribution base: RMB 4,775 (lower limit) to RMB 27,549 (upper limit).
- Employee Basic Medical Insurance (including maternity): Employer 5.5%, Employee 2.0%. Contribution base: RMB 4,669 (lower limit) to RMB 9,660 (upper limit).
- Work-Related Injury Insurance: Employer rate varies from 0.20% to 1.40% across eight industry risk categories, Employee 0%.
- Unemployment Insurance: Employer 0.8%, Employee 0.2%. Contribution base: RMB 2,300 (lower limit) to RMB 31,395 (upper limit).
Contribution responsibility: The employer and the foreign employee share the contribution obligation in accordance with the statutory rates. The employer is responsible for withholding the employee's portion and remitting the total contribution to the social insurance authority on a monthly basis. The employer is required to complete the contribution declaration and payment through the tax authority's electronic platform.

The application is submitted through the National Social Insurance Public Service Platform (http://si.12333.gov.cn), the electronic social security card, or the "Zhang Shang 12333" APP. Upon approval, the Certificate of Coverage is downloaded and submitted to the Foshan social insurance authority to obtain the exemption.

China has signed bilateral social security agreements with 13 countries. These agreements are designed to resolve the dual-contribution problem faced by cross-border workers and to protect their social security rights through mutual exemption of contributions. Nationals of countries covered by an agreement in force may be exempt from paying certain social insurance contributions for the period specified in the relevant agreement.
Countries with Agreements in Force
- Agreements in force (12 countries): Germany, South Korea, Denmark, Canada, Finland, Switzerland, the Netherlands, Spain, Luxembourg, Japan, Serbia, and Kyrgyzstan (agreement entered into force on 14 October 2025).
- Signed but not yet in force: France.
- Covered insurance types: Primarily basic endowment insurance and unemployment insurance. The specific insurance types covered vary by country and are determined by the applicable bilateral agreement.
- Exemption period: Generally, the maximum initial exemption period for dispatched personnel is 60 calendar months, with some countries allowing up to 72 calendar months. The specific period is determined by the applicable agreement.
Certificate of Coverage Application
- Application channel: The application is submitted online through the National Social Insurance Public Service Platform (http://si.12333.gov.cn), the electronic social security card, or the "Zhang Shang 12333" APP. Offline applications are no longer accepted.
- Application subject: For dispatched employees, the domestic employer submits the application on behalf of the employee; the application is not accepted from individuals. For flexible employment or self-employed persons, the individual submits the application.
- Required documents: For dispatched personnel, a dispatch letter or dispatch statement is required. For individual applicants, proof of domestic social insurance contribution for the past 3 months and a valid passport are required.
- Processing and use: Upon approval, the Certificate of Coverage is downloaded and printed with an electronic official seal. The certificate is submitted to the Foshan social insurance authority to obtain the exemption. The employer must ensure that the foreign employee continues to fulfil domestic contribution obligations during the exemption period, as failure to do so may affect the exemption entitlement.
Social Insurance Benefits & Account Handling

Entitlement to Benefits
- Equal treatment: Foreign nationals participating in social insurance are entitled to social insurance benefits in accordance with the law when they meet the statutory conditions, on the same basis as Chinese employees.
- Pension benefits: Upon reaching the statutory retirement age and meeting the minimum contribution period, the foreign national is entitled to a monthly basic pension.
- Medical benefits: The foreign national is entitled to reimbursement of medical expenses covered by the employee basic medical insurance, subject to the applicable deductible and reimbursement ratios.
- Other benefits: Work-related injury benefits, unemployment benefits, and maternity benefits are available subject to the statutory conditions and procedures.
Account Handling Upon Departure
- Account retention: If the foreign national leaves China before reaching the statutory pension age, their social insurance personal account is retained. If the foreign national returns to work in China in the future, the contribution years are cumulatively calculated with the prior contribution period.
- Lump-sum withdrawal: Alternatively, the foreign national may submit a written application to terminate their social insurance relationship and receive the balance in their personal social insurance account in a lump sum.
- Inheritance: If the foreign national passes away, the balance in their social insurance personal account may be inherited in accordance with the law.
- Annual qualification verification: Foreign nationals receiving monthly social insurance benefits outside China must verify their benefit eligibility annually. The verification may be completed through the Internet or by providing a survival certificate issued by a Chinese embassy or consulate, or a notarised and authenticated survival certificate from the country of residence.
Compliance note: Maintaining valid social insurance coverage is both a legal obligation and a protective measure for the foreign employee. Gaps in coverage can affect eligibility for benefits and, in the case of work-related injuries, may leave the employer liable for full compensation. If the employer fails to rectify, a fine of not less than one time and not more than three times the amount of social insurance premiums payable shall be imposed, and the directly responsible managers and other directly responsible personnel shall be fined not less than RMB 500 and not more than RMB 3,000.
- Failure to pay contributions in full and on time (Article 86, Social Insurance Law): The social insurance premium collection agency shall order the employer to pay the outstanding amount within a specified period or make up the shortfall, and a late payment surcharge of 0.05% per day shall be added from the date of default. If the employer still fails to pay, an administrative fine of not less than one time and not more than three times the amount of the outstanding contributions shall be imposed.
- Employer liability for work injuries: If a foreign employee suffers a work-related injury during a period when social insurance was not properly paid, the employer may be liable for the full amount of compensation that would otherwise be covered by work-related injury insurance.
Dispute Resolution
- Legal remedies: If a foreign national who participates in social insurance in accordance with the law has a dispute with their employer or domestic work unit regarding social insurance, they may apply for mediation, arbitration, or initiate legal proceedings in accordance with the law.
- Administrative complaint: If the employer or domestic work unit infringes upon the foreign national's social insurance rights and interests, the foreign national may also request the social insurance administrative department or the social insurance premium collection agency to handle the matter in accordance with the law.
- Invalid agreements: Any agreement between the employer and the foreign employee purporting to waive the obligation to pay social insurance contributions is invalid and unenforceable.
