Residence Permit Extension, Change & Cancellation
MAINTAINING VALID STATUS THROUGHOUT THE EMPLOYMENT LIFECYCLE
Extension
- Timing: Foreign nationals applying to extend their residence permit must submit the application to the Exit-Entry Administration 30 days before the current residence permit expires.
- Supporting materials: The application requires the foreigner visa application form, photograph and digital receipt, passport and current residence permit, temporary residence registration form, and updated supporting documents corresponding to the residence purpose (such as a renewed work permit or employer certificate letter).
- Review: If the reasons for extension are reasonable and sufficient, the extension is granted. If not, the applicant must leave China before the current permit expires.
Change of Registration Items
- Timing: If any registered item on the residence permit changes — including the holder's name, gender, date of birth, purpose of residence, period of residence, issuing date, issuing place, passport number, or other international travel document number — the holder must apply for a change at the Exit-Entry Administration within 10 days from the date the change occurs.
- Common change scenarios: Renewal of passport, change of employer (where the position remains the same and the work permit is updated), change of residential address, and correction of personal information.
- Consequences of non-compliance: Failure to apply for a change within the statutory 10-day period may result in the residence permit being declared void by the issuing authority, and the foreign national may be treated as residing unlawfully.
Cancellation
- Circumstances: The residence permit may be cancelled upon the foreign national's departure from China, upon death, upon a change of residence purpose that is not filed within the statutory period, or where the permit is declared void due to damage, loss, theft, or a decision of限期出境,遣送出境, or驱逐出境.
- Employer coordination: When a foreign employee leaves the employer, the work permit cancellation and residence permit handling must be coordinated. If the employee will not continue working in China, the residence permit must be cancelled or converted to a stay visa (T visa) valid for no more than 30 days to ensure lawful departure.

Frequently Asked Questions About Foshan Residence Permits
COMMON QUESTIONS FROM EMPLOYERS AND FOREIGN EMPLOYEES
Q1: How soon after entering China must I apply for a residence permit?
If your visa indicates that a residence permit is required after entry, you must submit the application to the Exit-Entry Administration within 30 days from the date of entry. Our team prepares the complete application package and schedules the appointment well in advance to ensure the deadline is met.
Q2: How long is a work-type residence permit valid?
Work-type residence permits are issued for a minimum of 90 days and a maximum of 5 years. The actual period granted depends on the work permit duration and the employer's compliance record. Our team confirms the applicable period during the eligibility assessment.
Q3: When should I apply to extend my residence permit?
You must submit the extension application to the Exit-Entry Administration 30 days before your current residence permit expires. If the extension is not granted, you must leave China before the current permit expires. Our team tracks expiry dates and initiates the extension process in advance.
Q4: What should I do if I renew my passport?
If you renew your passport, the passport number on your residence permit changes. You must apply for a change of registration items at the Exit-Entry Administration within 10 days from the date the new passport is issued. Failure to do so may result in the residence permit being declared void. Our team prepares the change application and schedules the appointment.
Q5: Do I need to appear in person for the residence permit application?
Yes. The applicant must appear in person at the Exit-Entry Administration for on-site facial image capture and fingerprint data collection. Our representative accompanies you throughout the on-site process, handles the document submission, and responds to any officer inquiries on your behalf.
Q6: What happens to my residence permit when I change employers?
When you change employers, the work permit must first be cancelled by the previous employer and a new work permit application must be submitted by the successor employer. Once the new work permit is issued, the residence permit must be updated to reflect the new employer. If the position remains the same and the residence permit is still valid, the process can be completed within China. Our team coordinates the entire sequence.
Q7: What are the penalties for overstaying my residence permit?
Under Article 78 of the Exit and Entry Administration Law, unlawful residence of 10 days or less results in a warning. For unlawful residence of more than 10 days but less than 60 days, the penalty is a fine of RMB 500 per day, up to a maximum of RMB 10,000, or detention of 5 to 15 days. For unlawful residence of 60 days or more, the penalty is a fine of RMB 10,000 or detention of 5 to 15 days. Our team monitors all deadlines to prevent any lapse in status.
Q8: Can I convert my residence permit to a different category while in China?
In certain circumstances, foreign nationals may apply to change their residence purpose while in China, provided the change complies with the relevant regulations and the applicant meets the conditions for the new category. The application must be submitted to the Exit-Entry Administration with the supporting documents corresponding to the new residence purpose. Our advisors assess eligibility and prepare the application.
